This appearance comes despite her legal team asserting that the procedure is fraught with legal inconsistencies.
Roberto Gil Zuarth, the governor’s lawyer, announced his intention to file a criminal complaint against those responsible for initiating a process that he argues disregards the governor’s constitutional immunity. Gil Zuarth explained that the summons calls Campos as a witness but includes legal grounds typically applicable to indicted individuals. This, he stated, implies the opening of a criminal investigation without the necessary declaration of origin.
Constitutional Immunity and Procedural Violations
Gil Zuarth emphasized that for any proceedings against an official with constitutional immunity, approval from both the Chamber of Deputies and the local Congress is indispensable. He pointed out that the summons lacks specific questions and merely orders a personal appearance, which, in his view, places the governor in a vulnerable legal position.
The defense attorney accused the FGR’s actions of potentially being a “trap,” by summoning her as a witness while simultaneously leaving open the possibility of considering her an indicted party. Consequently, he stated that he would file a complaint in the coming hours, based on Article 125, Section XIX, of the Federal Criminal Code, citing a violation of constitutional procedure.
Call for Investigation into FGR Actions
Finally, Gil Zuarth maintained that those who ordered the initiation of the procedure should be investigated and face the corresponding legal consequences.
