Mexico City Congress Bans Pet Exhibition in Cages or Showcases

Mexico City, December 11 – The Mexico City Congress has enacted a new law prohibiting the physical exhibition of companion animals, such as dogs and cats, that are awaiting adoption. This measure aims to reduce stress on animals, with commercial establishments, shelters, or refuges facing fines of up to 339,000 pesos for non-compliance.

Reducing Animal Stress and Promoting Welfare

The primary objective of this reform is to mitigate stress in animals. Studies indicate that continuously exposing pets in showcases or cages to passing individuals, intense lighting, and/or noise can lead to excessive stimulation and abnormal behaviors. These include repetitive movements, nervousness, constant alertness, apathy, and even aggression. Such confinement factors are deemed detrimental to animal welfare and constitute a form of animal cruelty.

According to the reform, the sale and adoption of these animals must now be conducted by appointment only. Prior to adoption or sale, animals must be housed in secure and protected areas, provided with adequate food and clean water, and supervised permanently by a veterinary zoologist and trained personnel.

Key Provisions of the New Law:

  • Return Policy: If a guardianship is not assumed, the animal must be returned within 72 hours, and a reintegration fee will be charged for its care and rehoming.
  • Sterilization and Health: Only sterilized and dewormed dogs and cats will be commercially sold. The purchase certificate must guarantee minimum health conditions and traceability of the animal.
  • Buyer Information: Buyers are legally mandated to receive accurate and comprehensive information regarding animal care and behavior.
  • Veterinary Claims: A 15-day period is granted for claiming veterinary attention for hidden or incubating diseases, and up to 9 months for congenital diseases.
  • Age Restriction: The sale of puppies younger than four months is strictly prohibited.

Penalties for Non-Compliance

In cases of violating these legal provisions, the Environmental and Territorial Planning Prosecutor’s Office (Procuraduría Ambiental y del Ordenamiento Territorial) will impose fines ranging from 150 to 3,000 units of measurement and updating. This translates to approximately 16,900 to 339,000 pesos.

It is estimated that Mexico City hosts around 2,216 establishments related to companion animal services, encompassing everything from pet food sales to veterinary services. These establishments will be directly impacted by the new regulations.

Implementation Timeline and Future Directives

The reform is scheduled to take effect 365 calendar days after its publication in the Official Gazette of Mexico City. During this transitional period, authorities are tasked with issuing guidelines for the locations and spaces designated for animals to ensure full compliance with the new law.

This legislative change underscores Mexico City’s commitment to enhancing animal welfare and ensuring more humane treatment for companion animals awaiting new homes. The focus on reducing stress and providing proper care during the adoption process is a significant step forward in animal protection efforts within the capital.
