Mexico City Congress Urges Guaranteeing Digital Platform Workers’ Rights

Mexico City Congress Calls for Strengthening Labor Inspections to Protect Digital Platform Workers’ Rights

Mexico City, September 24 – The Mexico City Congress has urged the strengthening of labor inspections to ensure the rights of digital platform workers are guaranteed. This includes proper payments, accurate recording of working hours and waiting times, and access to social security. The proposal was directed to the federal Secretariat of Labor and Social Welfare (STyPS) and the Mexico City Secretariat of Labor and Employment Promotion (STyFE).

Unanimous Approval for Worker Protection

During a regular session on Thursday, a Point of Agreement presented by a MORENA legislator was unanimously approved by the Plenary. Speaking from the legislative tribune, the legislator emphasized that while the growth of digital applications has transformed employment methods, individuals working through these new tools must still be afforded their fundamental labor rights.

“Behind every application and every algorithm, there is a person working, a person with the right to know how much they are paid, to have their hours and waiting times correctly registered, to receive payment receipts, and to have social security and housing contributions,” the legislator stated.

Addressing the Gap in Social Security Coverage

The representative highlighted that Mexico currently has over 1.5 million individuals affiliated with digital platforms. However, only 247,900 of these workers meet the income threshold required to access comprehensive social security coverage. This significant disparity underscores the urgent need for robust oversight.

In light of these figures, the legislator stressed the necessity of verifying the proper application of existing regulations and ensuring that income used to determine social security access is accurately calculated. “These data do not, by themselves, signify a violation of the law, but they do oblige us to verify that the rules are being complied with; that hours and waiting times are correctly registered; and that receipts reflect what has actually been worked to determine access to social security,” the MORENA member clarified.

Ensuring Compliance, Not Persecution

Rubio Gualito, President of the Labor Affairs, Work, and Social Welfare Commission of the Mexico City Congress, specified that the Point of Agreement regarding labor inspections is not intended to persecute digital platforms. Instead, its objective is to confirm that employer obligations are met and that the recognized rights of workers are effectively protected.

He further warned that while new technologies and employment models may continue to evolve, this should not diminish the protection of labor rights. “The dignity of those who work will not change. That is why we propose urging federal and local labor authorities to strengthen and intensify inspections in this sector,” Rubio Gualito concluded.

The Broader Context of Digital Labor

The call from the Mexico City Congress reflects a growing global concern regarding the working conditions and rights of individuals employed in the gig economy. As digital platforms become increasingly integral to modern economies, legislative bodies worldwide are grappling with how to adapt existing labor laws to these new models of employment. The aim is to strike a balance between fostering innovation and ensuring fair treatment and protection for all workers.

This initiative by the Mexico City Congress marks a significant step towards formalizing and safeguarding the rights of a rapidly expanding segment of the workforce, potentially setting a precedent for future labor policies in the digital age.
